Know all men by these presents that Mary Ann Cowley of Cronk Urleigh in the parish of Michael, widow, is held and firmly bound to John Mylrea of Cronk Urleigh aforesaid (a lunatic so found by inquisition) in the sum of one hundred pounds to be paid to the said John Mylrea - for which payment the said Mary Ann Mylrea binds herself, her heirs, executors and administrators firmly by these presents
And for the further and better security of the said John Mylrea in payment thereof
Further know ye that the said Mary Ann Cowley grants and conveys to the said John Mylrea all and singular the hereditements and premises set forth and described in the schedule hereunder written and hereinafter called "the scheduled property", to hold to the said John Mylrea, his executors, administrators and assigns until the said principal sum of one hundred pounds be fully paid and satisfied
In witness whereof the said Mary Ann Cowley has hereunto subscribed her name this seventh day of December one thousand nine hundred and two
Whereas the said Mary Ann Mylrea is one of the committee duly appointed by the Chancery Division of the High Court of Justice of the above named lunatic
And whereas the lunatic is entitled inter alia to an interest or share in certain real estate in the parishes of Conchan and Michael
And whereas the income of the said real estate is wholly insufficient for the purpose of paying for the maintenance and clothing of the said lunatic and a sum of one hundred and seventy pounds was at the time of the application to the said Division herein after mentioned, due to the said Mary Ann Cowley for such clothing and maintenance by the committee
And whereas under the authority of various orders of the said Division, the Committee sold the real estate of the lunatic and the total proceeds thereof after deducting expenses of sale amounted to the sum of one hundred and eighty pounds or thereabouts
And whereas there are certain debts incurred by the committee in and about the administration of the estate of the said lunatic, and the application to the said Division which amount to the sum of on hundred and twenty three pounds or thereabouts
And whereas the committee and the said Mary Ann Cowley presented their petition to have their accounts passed and allowed by the court, and to have the proceeds of the sale of the said real estate applied in the amount shown by the said accounts to be due to the said Mary Ann Cowley in respect of the said maintenance and clothing of the said lunatic aforesaid, she the said Mary Ann Cowley undertaking to pay the said debts amounting to one hundred and twenty three pounds and the court made such order (Elizabeth Corlett the party noticed to the proceedings consented thereto) subject to the said Mary Ann Cowley undertaking to clothe and maintain the said lunatic for the remainder of his natural life and intering into the foregoing bond and security in the sum of one hundred pounds to secure the performance of such undertaking
Now the Condition of the foregoing Bond and Security is that if the said Mary Ann Cowley shall clothe and maintain (to the satisfaction of the Committee or the Court) the said lunatic for the remainder of his natural life then the foregoing Bond and Security shall be void, otherwise it shall be and remain in full force and virtue to the full extent of the sum of one hundred pounds
SCHEDULE WITHIN REFERRED TO
All and singular one undivided half or moeity of a certain meadow situate in the parish of Michael and containing one acre and three roods or thereabouts, adjoining Ballacarnane and bounded on the north by Ballameanagh, on the south by Ballameanagh aforesaid, on the east by Ballameanagh aforesaid, and on the west by Shalcagh
Also all and singular an undivided fourth share of a certain plot or parcel of land situate in Big Well Street in the borough of Douglas and parish of Conchan, such plot being bounded on the north by Shaw's Brow, on the south by Big Well Street, on the east by the property in the occupation of Mr Kelly, and on the west by the property of Mr Stewart together with an undivided fourth share of a dwelling house yard and premises on such plot situate and numbered thirty in Big Well Street aforesaid
Also all and singular one undivided fourth share of a certain plot or parcel of land situate in Wellington Square in Douglas and Conchan aforesaid such plot being bounded on the north by the property of John Clark, on the south by the property in the occupation of John Skillicorn on the east by the property of Wellington Square aforesaid and on the west by a back yard together with a fourth share of the dwelling house and premises erected on such plot and situate and numbered seventeen in Wellington Square aforesaid . NOTES
- Cronk Urleigh
- Mary Ann was the daughter of John Mylrea and Margaret Barrie als Brew
- She was a widow, after her husband died in 1900
- She had cared for her brother, John, since the death of their father in 1887
- In 1902, Mary Ann sold John's assets which, she argued, would compensate her for the cost of maintaining him in food and clothing and shelter
- She immediately repurchased the assets in her own name
- John, the subject of this petition, suffered an injury that caused his disability in 1876 in Manchester and received a pension of 6/- per week from the Manchester Joiner's Benefit Club. In 1881 when, in the census, he was living with his parents and listed as a joiner (formerly). The word "imbicile" is added
