MARY ANN COWLEY als MYLREA & husband to Samuel Harris

Mortgage - 1896 (Douglas)

Know all men by these presents that John Corkill Watterson Cowley of Cronk Urleigh in the parish of Michael, gentleman, (who and his heirs, executors and administrators are hereinafter included under the expression "the mortgager") doth hereby own and acknowledge himself to be and stand justly endebted unto Samuel Harris of the town of Douglas, surviving executor of the last will and testament of John Cannell, late of the town of Douglas, Coroner, deceased (who and his executors, administrators and assigns are hereinafter included under the expression "the mortgagee") in the full and just sum of two hundred and fifity pounds sterling to the payment whereof with interest thereon at and after the rate of five pounds per centum per annum payable half yearly (reducible nevertheless and payable at and after the rate of four pounds per centum per annum if paid punctually half yearly as the same becomes due or within one month thereafter) and all costs and charges attending these presents, and any assignments or assignment hereof well and truly to be made unto the mortgage, the mortgagor binds and obliges himself firmly by these presents and for the further and better security of the morgagee in the premises

Further know ye that the mortgagor and Mary Ann his wife do hereby give and grant, transfer, assign and pass over in security unto the mortgagee all and singular that dwelling house and those lands and premises thereto belonging and adjoining, all situate in the parish of MIchael aforesaid and called Cronk Urleigh as described in a Deed of Sale thereof, and on the plan attached or at first of the same deed of sale and containing by measurement twelve acres one rood and two perches or thereabouts and which said Deed of Sale is granted by Ethel Cross formerly Chadwick of St Aubyns West Brighton in England and Edgar Hewitt of the City of Manchester in England, solicitor, trustees under the will of the late James Chadwick esquire of Ravensdale in the parish of Ballaugh in this island, deceased, and which said Deed of Sale bears date on .. 28 day of February 1896

To hold the same with all the right, title and interest both legal and equitable of the mortgagor and his said wife therein and thereto unto the mortgagee from the date hereof until repayment of the said principal sum of two hundred and fifty pounds sterling and all interest, costs and charges aforesaid and it is hereby agreed and declared that it shall be lawful but not compulsory for the mortgagee forthwith to insure or cause to be insured from damage or loss by fire the whole or any part of the buildings erected on the premises hereby given in security in such insurance office as he or they may from time to time select in any sum or sums not exceeding the sum of two hundred and fifty pounds and to recover the annual premiums paid or to be paid by him or them in respect of such insurance, along with the interest to arise hereunder from the mortgagor and such premiums whilst unpaid to the mortgagee shall be a lien and charge on the property given in security and a part of the costs and charges aforesaid

And it is also hereby agreed that the said principal money shall not be called in by the mortgagee or paid off by the mortgagor unless such party requiring to call in or pay off the same shall give the other party six calendar months notice in writing of such his or their intention so to do and such notice when given by one party shall operate for the benefit of both and also that any notice to be served on the mortgagee shall be a good notice if sent to the last known place of residence within this Isle of the mortgagor or left at the said mortgaged premises

And for the true and faithful performance hereof the mortgagor binds and obliges himself, his heirs, executors and administrators firmly by these presents

  2. John Corkhill Watterson Cowley married Mary Ann Mylrea in 1891. He was theology student and later a school teacher
  3. Mary Ann was the daughter of John Mylrea and Margaret Barrie als Brew
  4. Cowley purchased a tenancy in Michael, adjacent to the Mylrea holding, in February 1896. It doubled the existing Cronk Urleigh tenancies
  5. This contract is for a mortgage of £250 from Samuel Harris, from whom he'd borrowed money previously in Douglas
  6. In his will in 1900, John Corkill Watterson Cowley left the Park Road dwelling (another of his purchases) to his wife during her lifetime. He also mentions "the remainder of my property in Douglas" and presumably the property to which he refers was jointly held with his wife Mary Ann as a result of her father's will. He left Cronk Urleigh to his older son, John Richard Stanley Cowley
  7. Other documents show Mary Ann's husband (in the decade they were married) had multiple land dealings including this current one. His purchases and mortgages amounted to about £1,000 and the sales considerably less
  8. Mary Ann repaid £150 of the mortgage out of her own monies a week after her husband took the mortgage. This action was undertaken & documented in an annex to the original mortgage document, and dated 14/3/1913 (not transcribed)
  9. Mary Ann repaid the outstanding £100 (1st May 1916) (not transcribed]
  10. Cowley conducted this purchase in his own name, as he did with #1 Park Road. How and when he acquired the funds to carry out either of these purchases is a mystery
