MORTGAGE - 1739 (Malew)

Know all by these presents that I Charles McYlrea jnr of Fildraw in the parish of KK Malew with the full and free consent and assent of my wife Mary McYlrea als Bridson divers good causes us thereunto moving but more especially for and in consideration of the full and just sum of twenty pounds already paid unto us before the signing and delivery hereof at and from the hands of Ewan Looney of the said parish have given, granted, passed over and mortgaged and y these present do give, grant, pass over and mortgage from us the said Charles McYlrea and Mary my wife our heirs, executors, administrators and assigns unto him the said Ewan Looney his executors, administrators or assigns all the right, title and interest that we now have or hereafter at any time may, might or could have in and unto certain parcels of Abbey land commonly called and known by the names the Garey, the Lough Volley and the Two Hills of such annual rent as shall be allotted thereupon by the Setting Quest for the full space, term and time of five years commencing from the 29th instant to have and to hold use, occupy and enjoy the premises aforesaid with all the ways, waters, watercourses, easements, liberties, profits and advantages thereunto or to any part thereof in anywise belonging or appertaining he the said Ewan Looney yielding and paying yearly and every year such rent as shall be allotted thereupon with all other dues, duties, suits and services payable out of the premises at times usual and accustomed and if in case the above sum be not justly repaid and satisfied unto the said Ewan Looney at the end or expiration of the said term of five years then it shall and may be lawful for him the said Ewan Looney his executors, administrators and assigns to continue possession of the premises for one year longer and so from year to year afterwards until the said sum of twenty pounds be fully and truly repaid and satisfied unto him the said Ewan Looney his executors, administrators and assigns by us the said Charles McYlrea and Mary my wife our heirs, executors, administrators and assigns provided nevertheless and it is agreed upon by and between the said parties that the said Charles McYlrea is to hold and enjoy the premises during the term of this mortgage paying yearly unto the said Ewan Looney or his executors the interest of twenty shillings out of the said principal sum upon the day of the commencement of this Deed but upon default or nonpayment of the said interest yearly upon the day prefixed then the same is to be charged on the premises for what interest shall or may happen to be in arrear and the same to be paid unto the said Ewan Looney or his executors when the above principal sum is to be paid by us the said Charles McYlrea and Mary my wife our heirs, executors, administrators and assigns and it is further agreed upon that if in case the said Charles McYlrea cannot hold and enjoy the above parcel called the Two Hills but that his father Charles McYlrea snr shall recover and possess one of them then the said Charles McYlrea jnr doth bind an oblige himself to give unto the said Ewan Looney or his executors another parcel of land equivalent to such part and parcel as the said Charles McYlrea snr shall possess and enjoy of the premises in this Deed mortgaged and likewise it is further agreed upon that whatever new fences the said Ewan Looney shall make in and upon any of the said premises then the said Ewan Looney is to be paid and reimbursed whatever charges or expenses he shall lay out on such fences he keeping a just, fair and true account of the same upon redemption of the premises and for the true and faithful performance hereof we the said Charles McYlrea and Mary my wife do bind and oblige ourselves, our heirs, executors, administrators and assigns in penalty and forfeiture of fifty pounds to be levied and paid according to law Witness our marks to our names this 27th September 1739 Charles McYlrea, Mary McYlrea my mark X

27th September 1739 Charles McYlrea and Mary McYlrea acknowledged the within and above Bill of Mortgage to be their voluntary act and deed before me Dan McYlrea

At an Abbey Court holden at Ballasalla the 12th October 1739 the above and within Bill of Mortgage being acknowledged before the Deemster and now published in open Court and no objection offered against it the same is therefore allowed of and confirmed according to law J.Murray, Dan McYlrea, Charles Stanley, John Quayle, William Christian

24th September 1744 I Ewan Looney the mortgagee do hereby acknowledge to have received from William Stole for and in behalf of Charles McYlrea the full consideration money of this mortgage being twenty pounds with all charges attending the same therefore this deed is cancelled Witness my hand Ewan Looney

  2. Charles jnr was the only surviving son born to Charles McYlrea snr & Margaret (als Kewley?)
  3. He married Mary Bell als Bridson c1736; five children Charles (1738-1741), John (1740), Robert (1742), William (1746), Thomas (1750)
  4. Mary died 1782; Charles jnr 1792. Son Charles died in infancy; records for other four sons not found
  5. The oddity of this mortgage is that Charles snr was still alive but was not involved in this mortgage - was he abroad or in some way incapacitated?
  6. There is much about the Malew Mylreas of the 1600s and early 1700s that does not hang together so extreme caution must be exercised
