Mortgage - 1748 (Malew)

Know all men by these presents that I Charles McYlrea of Fildraw Moare in the parish of KK Malew with the full and free consent of Mary my wife for and in consideration of the full and just sum of seventy pounds to us in hand paid the receipt whereof we do hereby acknowledge by and from the hands of Mr Matthew Taubman of the parish of KK Arbory have given, granted, demised and mortgaged and by these present do give, grant, demise and mortgage unto him the said Mr Matthew Taubman his heirs, executors, administrators and assigns all the right title or interest we now have, heretofore had, and at any time hereafter may, might or could have of, in and unto a certain parcel of Abbey farm land in the said KK Malew being our part of the beforesaid Fildraw Moare it being of the yearly Abbey rent of three shillings and four pence halfpenny or thereabouts for the term of five years commencing from the first day of November next to have and to hold the beforesaid three shillings and four pence halfpenny rent unto him the beforesaid Mr Matthew Taubman his heirs, executors, administrators and assigns from us the said Charles McYlrea and Mary my wife our heirs, executors, administrators and assigns with all ways, waters, watercourses, easements, liberties, properties and advantages to the premises in anywise belonging or appertaining he yielding and paying the annual Abbey rent aforesaid with all other dues, boons, suits and services due and payable out of the premises at the times and seasons accustomed and I the beforesaid Charles McYlrea and Mary my wife do hereby bind and oblige ourselves our heirs, executors, administrators and assigns to uphold, awarrant, maintain and defend the beforementioned premises unto him the beforesaid Mr Matthew Taubman his heirs, executors, administrators and assigns against the pretended right of any person or persons claiming any right to any part, parcel or member of the premises and to do or perform any thing or things that in law or equity shall be found requisite to be done for the better strengthening hereof and everything herein contained and it is hereby agreed upon notwithstanding what is mentioned in this mortgage that it shall and may be lawful for us the said Charles McYlrea and Mary my wife to hold the beforesaid premises for the beforesaid five years paying unto the beforesaid Mr Matthew Taubman his heirs executors administrators or assigns the yearly interest of the beforesaid sum of seventy pounds at the rate of five pounds out of the hundred pounds but if in case the beforesaid sum together with the intest be not paid at the end of the said five years then and in that case it shall and may be lawful for the said Mr Matthew Taubman to enter upon the premises and to hold the same from year to year until the said principal sum together with what interest that will be due and in arrear will be fully paid and satisfied as the Act of Settlement provides in such cases and for the true and faithful performance hereof and everything herein contained I the said Charles McYlrea and Mary my wife do hereby bind and oblige ourselves in the penalty or forfeiture of double the value to be paid according to law As witness our subscriptions this 2nd day of July 1748 Charles McYlrea, Mary McYlrea my mark X

2nd July 1748 Charles McYlrea and Mary McYlrea acknowledged the within and above Bill of Mortgage to be their voluntary act and deed before me John Taubman

At an Abbey Court holden at Ballasalley the 14th October 1748 the beforegoing Bill of Mortgage being acknowledged before the Deemster and now openly published in Court and no objection offered against it is therefore allowed of and confirmed according to law ..   1. Fildraw
  2. Charles jnr was the only surviving son born to Charles McYlrea snr & Margaret (als Kewley?)
  3. He married Mary Bell als Bridson c1736; five children Charles (1738-1741), John (1740), Robert (1742), William (1746), Thomas (1750)
  4. Mary died 1782; Charles jnr 1792. Son Charles died in infancy; the fates of the other four sons is not recorded
  5. This is a very large mortgage, and extended by £30 4 years later so it would seem Charles jnr could not service the original loan. This mortgage came immediately after the sale of a Fildraw field for  £60, further demonstrating that Charles's financial woes were significant and virtually unmanageable
  6. There is much about the Malew Mylreas of the 1600s and early 1700s that does not hang together so extreme caution must be exercised
