DANIEL MYLREA et al from LEWIS GENESTE

PURCHASE - 1778 (Douglas)

This indenture made the twenty-first day of February in the year of our Lord one thousand seven hundred and seventy-eight between Lewis Geneste of the town of Douglas merchant of the one part and John Taubman of Castletown and Daniel Mylrea and Robert Heywood of Douglas aforesaid merchants of the other part witnesseth that for and in consideration of the full and just sum of twenty-one pounds British to him the said Lewis Geneste in hand well and truly paid by the said John Taubman, Daniel Mylrea and Robert Heywood at or before the execution of these presents the receipt whereof is hereby acknowledged and for and in consideration of the covenant of the said John Taubman, Daniel Mylrea and Robert Heywood hereinafter mentioned he the said Lewis Geneste hath granted, bargained, sold, aliened and confirmed and by these presents doth grant, bargain, sell, alien and confirm unto the said John Taubman, Daniel Mylrea and Robert Heywood their heirs, executors, administrators and assigns all that piece, parcel or lot of ground situate on and part of the Nunnery How adjoining the brewery malt kiln and concerns of the said Robert Heywood on the west and that lot or parcel of ground sold by Thomas Heywood esq to John Edmondson on the east containing in length or front to Douglas harbor or river fifty yards and in [rear?] or depth backwards towards the said How thirty yards exclusive of a quay in front of the said premises towards the said Harbour which is to be eight yards broad together with all and singular the rights, members, privileges and appurtenances whatsoever thereunto belonging or in any wise appertaining and all the estate, right, title and interest of him the said Lewis Geneste therein or thereto under and by intent of a certain Deed or transfer bearing date the twenty ..day of October one thousand seven hundred and [sixty?] two executed by Peter John Heywood esq and Elizabeth his wife to the said Lewis Geneste to have and to hold one equal third part of the said lot or parcel of ground and premises hereby transferred or intended to be with its appurtenances unto the said John Taubman his heirs, executors, administrators and assigns forever free from the claim, challenge or demand of him the said Lewis Geneste his heirs, executors or administrators and other persons whomsoever subject to one equal third part of all and every the legal charges thereupon incumbent and to have and to hold one other third part or share of and in the said lot or parcel of ground and premises hereby transferred or intended to be with its appurtenances unto the said Daniel Mylrea his heirs, executors, administrators and assigns forever free from any the claim, challenge and demand of him the said Lewis Geneste his heirs, executors or administrators and of all persons whomsoever subject to an equal third part of all legal charges thereupon incumbent and to have and to hold one other equal third part of and in all that the said parcel of ground and premises hereby transferred or intended to be with its appurtenances unto the said Robert Heywood his heirs, executors, administrators and assigns forever free from any claim, challenge and demand of any person or persons whomsoever subject nevertheless to one equal third part of all legal charges thereupon incumbent and the said Lewis Geneste doth hereby for himself his heirs, executors and administrators covenant with the said John Taubman, Daniel Mylrea and Robert Heywood their heirs, executors and administrators that the said Lewis Geneste hath good right, full power and lawful authority to assign and transfer all and singular the aforesaid premises in manner and form as he hath hereby done and also the said Lewis Geneste his heirs, executors and assigns shall and will at any time or times when thereto required by and at the costs and charges of the said John Taubman, Daniel Mylrea and Robert Heywood their heirs, executors, administrators and assigns make, do and execute any further or other conveyance to ratify and confirm these presents and further that they the said John Taubman, Daniel Mylrea and Robert Heywood their heirs, executors and administrators shall and may lawfully from time to time and at all times hereafter peaceably and quietly possess, occupy and enjoy the said hereby assigned premises without any interruption whatsoever and warranted and defended by the said Lewis Geneste his heirs, executors and administrators unto the said John Taubman, Daniel Mylrea and Robert Heywood their heirs, executors, administrators and assigns against the claims, challenges, pretensions or demands of him the said Lewis Geneste his heirs, executors and administrators and of all and every other person or persons whomsoever and for the consideration aforesaid they the said John Taubman, Daniel Mylrea and Robert Heywood do hereby for themselves their heirs, executors and administrators covenant with him the said Lewis Geneste his heirs, executors and administrators to do and execute all and every the acts, deeds, matter and things which were to have been performed by the said Lewis Geneste his heirs, executors and administrators pursuant to the said Deed or transfer executed by the said Peter John Heywood and Elizabeth his wife as aforesaid and especially to pay off and discharge all rents and arrears of rent ..... due and payable in respect of the said hereby assigned premises and likewise to indemnify the said Lewis Geneste his heirs, executors and administrators against the same in any wise and for performance of these presents and covenants aforesaid the said parties bind themselves, their heirs, executors and administrators reciprocally and each to the other in the penal sum of five hundred pounds to be levied and paid according to law. Douglas district} High Bailiff’s office 5th April 1779 This day personally appeared the said Lewis Geneste, John Taubman, Daniel Mylrea and Robert Heywood the parties to this Deed and severally acknowledged the same to be their proper and mutual act and the said Lewis Geneste also acknowledged the receipt thereunto annexed to be his act and deed. At a Baron or Sheading Court holden at Douglas for Garff Sheading the 17th day of May 1779 The before written Deed of Sale hereunto annexed being acknowledged before the High Bailiff of Douglas and now openly published in Court and no object offered against the same is therefore allowed of, for and in the name of the most noble John, Duke of Atholl, Lord of the Manor of Mann and the Isles and confirmed by this Court. At an Abbey Court holden at the house of William Moore near Ballasally the 30th day of May 1788 The before written Deed of Sale having been acknowledged before the High Bailiff and now openly published in Court and no object offered against it the same is therefore allowed of and confirmed by this Court. NOTES

  1. Daniel Mylrea was the son of Thomas Mylrea & Rose Savage, and baptised Peel 1750
  2. His was the Deemster/Archdeacon/Attorney General line of Mylreas; once possessors of the Dollough estate
  3. He was already a young man of means, but in 1777sold off the Dollough, the Mylrea family estate in Ballaugh left to him by his bachelor uncle, Daniel Mylrea (Deemster) and netted about £3,000 in the process
  4. Daniel was in business in Douglas with Robert Heywood, his brother-in-law, and John Taubman snr
  5. These men were both of the Deemster families of the Isle of Man
  6. Daniel & Robert Heywood were recorded as ship owners, in 1781, importing goods to Liverpool from Barbados (Ref:Wilks)
  7. Heywood, Mylrea & Co were also money lenders as mortgages in 1788 & 1790 attest
  8. The Nunnery had been in the possession of the Heywoods for a long time; John Taubman jnr purchased the estate from Peter John Heywood (Robert's brother) in 1776 not long before the current transactions took place
  9. Lewis Geneste married Catherine Bridson, daughter of Ann Mylrea & John Bridson, in 1760. Ann was Daniel's great great aunt, and daughter of William Mylrea & Ann Christian
  10. A century later, in 1877, Daniel's grand daughter Rose Robertson als Mylrea married John Geneste Player-Frowd, a descendent of Lewis perhaps
