Assignment - 1894 (Lonan)

This Deed made the seventh day of December one thousand, eight hundred and ninety-four between John Mylroie jnr of Ballaraugh in the parish of Lonan, engineer, (and hereinafter called ‘the assignor’) of the first part, John James Quilleash Skillicorn of Claroye in the said parish of Lonan of the second part and Diana Kelly of No. 60 Buck’s Road in the town of Douglas, widow, (and herein after called ‘the assignee’) of the third part

Whereas James Skillicorn of Claroye in the said parish deceased and Jane his wife did on the fifteenth day of November one thousand, eight hundred and seventy-eight grant and pass their Deed of Bond and Security unto the assignor for the principal sum of six hundred pounds sterling payable with interest, costs and charges and charging and encumbering all and singular certain lands and premises situate in the said parish of Lonan being part of the Quarterland of Gretch voar and a parcel of Intack land adjoining called Douchislieu including the whole of the lands purchased by the said James Skillicorn of and from Thomas Cain and adjoining the lands of Thomas McKneale on the south-west, and the road leading to the Commons called Bare Hogg on the west, the lands of Matt Mylchreest on the north-west, the Commons on the north, and the other land of the said James Skillicorn on the east, and all and singular those lands and premises called and known by the name of Clayore being a parcel of Intack the property of the said James Skillicorn in the said parish together with all houses and buildings erected thereon and more particularly described in such Deed duly recorded

And whereas there is now due and owing under the said Deed of Bond and Security the said sum of six hundred pounds sterling, all interest, costs and charges up to the date hereof having being paid and discharged by the said John James Quilleash Skillicorn the heir at law of the said James Skillicorn and present owner of the property charged and encumbered as the assignor doth hereby admit and acknowledge and which sum the assignee hath agreed to pay to the assignor upon receiving from him an assignment of the said Deed of Bond and Security and the Covenant hereafter contained from the said John James Quilleash Skillicorn

Now these presents witness that the assignor in consideration of the said sum of six hundred pounds sterling the said principal money paid to him by the assignee (the receipt whereof is hereby acknowledged) doth hereby give, grant, transfer and assign unto the assignee the said sum of six hundred pounds sterling the full amount of principal money of the said Deed of Bond and Security of the 15th day of November 1878 and all interest accruing thereon together with the estates, lands and premises given in security by such Deed and together with the said Deed of Bond and Security or mortgage to have and to hold the same and all the right and interest of the assignor therein unto the assignee, her executors, administrators and assigns absolutely until the said principal sum with all interest, costs and charges due and owing thereon and to become due and owing thereon shall be fully paid and satisfied in as full and ample a manner as the assignor might have held the same had this Deed not been executed

Provided always that the assignor shall under no circumstances be at any time hereafter liable for any defect in the title or otherwise of the premises charged and encumbered by the said Deed

And further know ye that the said John James Quilleash Skillicorn in consideration of the assignee taking the forgoing assignment doth hereby admit that the said principal money is due and owing under the said recorded Deed of Bond and Security and doth hereby bind and oblige himself, his heirs, executors and administrators to well and truly repay the same to the assignee, her executors, administrators and assigns together with interest thereon at and after the rate of five pounds ten shillings per centum per annum payable half yearly subject to be reduced to four pounds ten shillings per centum per annum provided the same be paid punctually when due or within one calendar month thereafter together with all interest, costs and charges and that the same shall be repaid on receiving six calendar months notice in writing from the assignee, her executors, administrators and assigns notwithstanding anything contained in the said Deed of Bond and Security and for the further security of the said assignee in the premises he doth grant and convey in security unto the assignee all and singular the said estate, lands and premises called Gretch voar, the said lands and premises called Douchislieu, and the said lands called Claroye together will all other the lands and premises of him the said John James Quilleash Skillicorn situate in the said parish of Lonan and whether Quarterland or Intack to have and to hold the same unto the assignee, her executors, administrators and assigns until repayment of the said principal sum of six hundred pounds together with all interest, costs and charges.

At Douglas Isle of Man 8 December 1894 John Thomas Cowin one of the subscribing witnesses to the execution of the foregoing Deed (who is known to me) made oath on the Holy Evangelist that John Mylroi and John James Quilleash Skillicorn the executing parties thereto duly signed and executed the same in deponent’s presence and in presence of James Williamson, the other subscribing witness thereto.   2. John Mylroie jnr was the younger - and only surviving - son of John Mylroie & Ann Quilleash. He was born in Lonan in 1846
  3. He was a miner as his father was, but over the years rose up the ranks to become an engineer
  4. He married Maria Killip in Liverpool in 1903 when he was 57. Maria had also been born in Lonan although the couple married in Liverpool
  5. There were no children of the marriage and, as his brother William died without issue, John's branch of the Mylroie clan came to an end
  6. This was the first surviving document that showed John as a money-lender. He died a wealthy man
  7. There is every likelihood that Jane, the wife of the deceased original borrower, James Skillicorn, was John's aunt, the sister of his mother Ann Quilleash
