Whereas Thomas Quaille claimeth and alledgeth that his father Gubbon Quaille pmissed at the daye of his handfastinge unto hym the on half of his wheat crope, the pties all (viz) the said Thomas, John McIlrea and Katherin Cowley, haith reffered the pmisse thereof to the oath of Donold Quaill who hath sworne the same and for the Devision thereof and consideracon wher the crope be better at this Instant or at the tyme pmisse all the said pties willinglie haith informed themselves to the order and arbitriment of foure men (vz) Phillip Corlod, Thomas Corlod, Jo: Stean and Willm Quine and haith bond themselves in the penaltie of x£ [£10] to her maties --- to stand thereby wch foure men haith ordered that the said Thomas Quaile shall have the on halfe of the crope as it nowe is, the other half quarter to the said Katherin Cowley and the other quarter be twixt of John McIlrea on the one syd and Thomas Quaile and his sistores on the other syd and to witness the same entrie of the said ptes hand put their signs manuell as also the four men have subscribed their names Notte that this order was appointed to be taken by the consent of the Demster and vic: gen-----

NOTES

  1. This is the first couple named John Mylrea and Katherine Cowley; the second almost a century later
  2. This document was amongst Ballaugh wills so presumably the event was in Ballaugh. Moreover, it was immediately following the will of Christian Mc Ylrea who died in 1600. She was a Dollough Mc ylrea
  3. The implication of its inclusion at that point of the collection of wills might be that the uncle John mentioned in Chrisitian's will is the John Mc ylrea who is a party to this dispute
