JOHN MYLREA from JOHN CALEY

MORTGAGE - 1834 (Ballaugh)

Know all men by these presents that I John Mylrea of Ballacooiley in the parish of Ballaugh for and in consideration of the sum of fifty Pounds British to me in hand paid by John Caley, the receipt thereof I do hereby acknowledge

Have given, granted, bargained, alienated, and passed over in mortgage and by these presents do give, grant, bargain, alienate and pass over in mortgage unto him the said John Caley all and singular that part of my estate called and known by the name of Faier-ne-dollagh being part of the quarter land of Dolly-wooar and of the annual chief rent of (blank)

To have and to hold unto him the said John Caley and his heirs, executors, and assigns from me the said John Mylrea and my heirs, executors and assigns beforegoing premises with all ways, waters, watercourses, easements and liberties to the same belonging or in anywise appertaining, in the nature of an absolute mortgage (according to the tenor of the Act of Settlement to that effect) until the said sum of fifty pounds British with interest thereout at the rate of 5% per annum be fully paid and satisfied, anything to the contrary notwithstanding

And for the true and faithful performance of all and singular the beforegoing Deed of Mortgage I the said John Mylrea with the full consent of Eleanor Mylrea otherwise Corlett my wife do hereby bind and oblige ourselves, our heirs, executors, administrators and assigns in and under the penalty of one hundred pounds British to be levied and paid according to law

3rd of October 1834 John Mylrea the executing party to the before written Deed of Mortgage acknowledged the same to be his proper act and deed before me J. Llewellyn

Whereas John Mylrea of Ballacooiley in the parish of Ballaugh did by a certain Deed of Mortgage bearing date the 2nd of October 1834 pass over in security all and singular that part of his estate called and known by the name Faie ny dhollaugh, part of the quarterland of Dhollaugh Moar unto John Caley for the principal sum of fifty pounds with interest at the rate of 5% per annum until paid, as by reference to such Deed may more fully appear

And whereas the said John Caley have subsequently departed this life, leaving a will bearing date the 22nd day of February 1856 by which he appoints his son Thomas Caley whole and sole executor of the said will

And at a Chapter Court holden at KK Michael on the 25 day of October 1840 (sic) probate of the said will was granted to Thomas Caley, the executor before named

And whereas the said John Caley did by a certain Deed of Assignment bearing date the 2nd day of May 1861 pass over the said Deed of Mortgage to Ann Kneen for the sum of eighty pounds including interest, costs and charges up to the date as by reference to such Deed duly recorded may more fully appear

And whereas the said mortgaged premises together with the estate of Ballacooiley were put up by public auction on the 26th day of February 1870 by virtue of an execution held by Thomas Clarke, Coronor of Michael Sheeding, and after various bids the said property was knocked down to the bid of John Cannell of Michael as buyer of the same

And the said John Cannell have paid to the said Ann Kneen the principal sum of fifty pounds together with all interest, costs and charges due upon the aforesaid Deed of Mortgage bearing date the 2nd day of October 1834 which deed was assigned over to her by Thomas Caley

Therefore know all men by these presents that I the aforesaid Ann Kneen do hereby own and acknowledge to have received and been fully paid at, by and from the hands of John Cannell the principal sum of fifty pounds amount of the aforesaid Deed of Mortgage with all interest, costs and charges due upon the same Deed assigned over to me by Thomas Caley, executor of John Caley as by reference to such Deeds may more fully appear

And I do hereby do order and direct that the said Deed of Mortgage shall and may stand cancelled on record as witness my subscription this the 12th day of October 1894. Ann X Kneen

At Douglas Isle of Man 13th October 1894 Margaret Cannell one of the subscribing witnesses to the execution of the beforegoing Deed (who is known to me) made oath on The Holy Evangelists that Ann Kneen the executing party thereto duly signed and executed the same in deponent's presence and in presence of Elizabeth Kneen the other subscribing witness thereto. NOTES

  1. John became the steward of Ballacooiley when his father John died in 1814 at the age of 76
  2. He was 55 when he took over, married to Eleanor Corlett and the father of 8 children, most of whom survived to adulthood
  3. Witness to his mortgage was his daughter Margaret
  4. Brother Daniel (b1761) and Mary Hughes had eight children in Ballaugh. As a teenager, he had been left a small legacy by his grandfather, Daniel Clark "to put him to some honest trade" but there's no evidence of what that trade might have been
  5. His other brother, Thomas, who was baptised in 1781, was most likely the fellow who married Ann Cannon in Braddan, and worked as a gardener/labourer
  6. John Caley was his brother in law, married to sister Ellinor so when Caley died, it was his son Thomas born 1810 who took over the mortgage (and therefore John Mylrea's nephew)
  7. In 1868, Ballacooiley was lost forever when the oldest son of John jnr, Thomas, was drowning in debt and the bank stepped in and sold the estate
