SALE - 1802 (Braddan)

Know all men by these presents that Major John Taubman of the Nunnery and Robert Heywood of the town of Douglas esquire for and in consideration of the sum of one thousand four hundred pounds lawful money of Great Britain to them paid or secured to be paid by Henry Holmes the elder, Henry Holmes the younger, John Holmes and James Holmes, of Liverpool trading under the firm of Henry Holmes and Sons have given, granted, bargained, sold, released and confirmed and by these presents do give, grant, bargain and forever absolutely sell, release and confirm unto the said Henry Holmes and Sons, their heirs and assigns all and singular those herring houses, buildings, yards and concerns situate on the south side of Douglas harbor and formerly the property of Messrs Heywood, Mylrea and Company which said premises are bounded by the quay on the north, a way, lane or passage on the east, and the lands of the said Robert Heywood on the south and west and are now in the actual possession of the said Henry Holmes and Sons as tenants thereof and bearing the annual Chief Abby Rent of two pence and one eighth of a penny or thereabouts to be the same more or less to have and to hold the said houses, buildings, yards and concerns with all ways, waters, watercourses, easements, liberties, rights, members, advantages and appurtenances to the same belonging unto the said Henry Holmes and Sons, their heirs and assigns, from the twelfth day of May next to their own proper use and behalf forever

And further know ye that the said Major John Taubman for and in consideration of the sum of eighty-four pounds lawful money of Great Britain to him paid or secured to be paid by the said Henry Holmes and Sons hath given, granted, bargained, assigned, released, quit claimed and confirmed unto the said Henry Holmes and Sons all and singular a certain rent charge or ground rent of four guineas a year payable to him the said Major John Taubman from and out of the said houses, buildings, yards and concerns to have and to hold the same unto the said Henry Holmes and Sons, their heirs and assigns from the day of the date hereof forever and the said John Taubman and Robert Heywood do hereby bind and oblige themselves, their heirs, executors and administrators to awarrant, maintain and defend the said houses buildings, yards and concerns with their and every of their appurtenances unto the said Henry Holmes and Sons, their heirs and assigns from and against the claim, challenge, or demand or all and every person and persons whomsoever

And for the performance of these presents, they bind themselves, their heirs, executors and administrators under penalty of five thousand pounds lawful money of Great Britain to be levied and paid according to law. In witness whereof the said John Taubman and Robert Heywood have hereunto subscribed their names and affixed their seals (and affixed their seals crossed out) the twenty-fourth day of August in the year of our Lord one thousand, eight hundred and two 1802. John Taubman and Robert Heywood esqs acknowledged the foregoing Deed of Sale to be their act and deed and to have received the consideration. Before me John Cosnahan

At an Abby Court holden at St Johns chapel the 18th October 1802 the before written Deed of Sale having been acknowledged before an High Bailiff and now openly published in Court and no objection offered against it, the same is therefore at the instance of the grantee’s ordered to be recorded or enrolled upon record. NOTES

  1. This sale should have marked the end of what might have been a tumultuous episode in the life of Daniel Mylrea, although he long since left the Isle of Man. He had been an original partner with Taubman snr & Robert Heywood in the construction and conduct of these herring houses. However, he was obliged to give up his share to Taubman snr because of a debt
  2. The purchasers, Henry Holmes & Sons, must have been renting the herring curing facilities since 1799, which perhaps not coincidentally was the year John Taubman snr died
  3. It would seem that John Taubman jnr, the vendor in the contract, saw the herring house books for the first time since his father died and was very unhappy to find that Daniel Mylrea had been borrowing money from the firm (and not repaying it) with the authority of Robert Heywood. Litigation ensued later that year.
