Mortgage - 1778 (Ballaugh)

Know all men by these presents that I Patrick Cowley of the parish of Ballaugh divers good causes me hereunto moving but chiefly and mores especially for and in consideration of the just and entire sum of one hundred pounds Manks currency now paid unto me before the execution of these presents by the Rev William Mylrea Archdeacon of this Isle and Rector of KK Andreas the receipt whereof I do hereby acknowledge have given, granted, alienated, demised and mortgaged and do by these presents give, grant, alienate, demise and mortgage unto him the said William Mylrea, his heirs, executors, administrators and assigns all that part of parcel of my Intack land situate in said parish of Ballaugh called and known by the name of Close Taggyrt bounded on the south by the lands of Thomas Kelly of Balla Corraige on the south-west by the lands of Philip Tear of Broaghjang beg on the north-west by the lands of John Mylvorrey on the north by widow Quayle’s land and on the east by the Ellan e Henny together with another parcel of Intack being part of Close Mooar situate in the parish of KK Christ Lezayre and lately purchased from William Tear of Balla beg of said parish of Ballaugh and bounded by the lands of Thomas Craine of the Glaick on the north-west, by the lands of Michael Cross on the north, by the lands of Joney Corlet and Mr John Harrison on the east and south-east and by said William Tear’s land on the south and west, the said promised parcels being respectively of such yearly Lord’s Rent as the Setting Quest shall adjust thereon to have and to hold unto him the said William Mylrea, his heirs, executors, administrators and assigns the aforesaid two several parcels of lands with all ways, waters, watercourses, easements, liberties, profits and advantages whatsoever unto them and each of them anywise belonging or appertaining to said premises in any respect whatsoever for and during the term of five years to be fully completed and ended commencing from the day of the date hereof he the said mortgagee, his executors and assigns yielding and paying the Lord’s Rent of the premises with all boons, suits and services annually incumbent upon the same during the continuance of this mortgage, and in case the said sum of one hundred pounds be not justly repaid at the end or expiration of said term of five years then it shall and may be lawful for him the said William Mylrea, his heirs, executors, administrators and assigns to continue the peaceable possession of the said mortgaged premises for one year long and so from year to year after until the said consideration money with all fees, costs and charges attending this mortgage be justly and truly repaid and satisfied according to the tenor and purpose of the Act of Settlement, provided nevertheless and it is hereby agreed upon and the true intent and meaning of these presents is that in case the said Patrick Cowley, his heirs, executors, administrators and assigns do pay or cause to be paid unto him the said William Mylrea, his executors or assigns the yearly interest of twelve pence Manks out of every pound of the said consideration money of one hundred pounds upon the day of the commencement hereof at every years end as the same shall become due, then it shall and may be lawful for me the said Patrick Cowley to continue possession of the premises myself with all boons, suits and services annually incumbent on the same but upon failure and non-payment of the said yearly interest prefixed as aforesaid then and in that case it shall and may be lawful for him the said William Mylrea, his heirs, executors, administrators and assigns to enter upon the said mortgaged premises and to have, hold, possess and enjoy the same to his own proper use and best advantage in every respect whatsoever until the said consideration money with all interest behind and in arrear and all costs and charges attending this mortgage be justly and truly paid and satisfied, anything to the contrary notwithstanding. And for the true and punctual performance of all and singular this Deed of Mortgage I the said Patrick Cowley do firmly bind and oblige myself, my heirs, executors, administrators and assigns in the penalty of two hundred pounds sterling. 27th April 1779 the said Patrick Cowley acknowledged the beforewritten Deed of Mortgage to be his proper and act and deed and to be fully paid the consideration money therein mentioned. Before me Thomas Moore

27th April 1779 The Setting Quest of the parish of Ballaugh and the Setting Quest of the parish of Lezayre all hereby ordered to proportion and settle the Chief Rent on the granted premises within the respective parishes whereof all proper parties are to have due notice to attend. Thomas Moore

The Setting Quest of the parish of Ballaugh doth settle and proportion on the premises in the within mentioned Bill of Mortgage the parcel called Close Taggart to bear and pay the yearly Lord’s rent of three shillings and eight pence and the parcel called Close Moar to bear and pay the yearly Lord’s Rent of three pence and this will ....... for our answer. At a Baron or Sheading Court holden at Peeltown for Michael Sheading the 14th May 1779 The before written Deed of Mortgage being acknowledged before the Deemster and now openly published in Court and no objection offered against it the same is therefore allowed of and in the name of the most honourable John, Duke of Atholl, Lord of the Manor of Mann and the Isles and confirmed by this Court. The Reverend William Mylrea Rector of KK Andreas do hereby acknowledge myself to be fully paid and satisfied at, by and from the hands of Patrick Kelly of KK Christ Lezayre in the just sum of one hundred pounds current money the same being the consideration money of a Deed of Mortgage passed over unto me by Patrick Cowley of the parish of Ballaugh and for said sum of one hundred pounds with all interest, costs and charges attending said Deed of Mortgage. I do hereby exonerate and discharge said Patrick Cowley, his heirs and assigns for the same and do hereby devise that the original Deed of Mortgage dated the 12th day of November 1778 may be cancelled upon record. 8th November 1783 James Radcliffe and William Radcliffe the subscribing witnesses made oath on the holy evangelist that the Rev William Mylrea the subscribing party duly executed the before written receipt and discharge in their presence.   1. Rev. William was the youngest surviving son of Daniel Mylrea & Lucy Parry, baptised 1722 in Ballaugh
  2. Married Ellinor Gell in Peel about 1755. Ellinor was an heiress whose father had died in 1743 (see below)
  3. Rev. William took holy orders, and was at various times Curate Andreas 1747-1754, Rector of Andreas 29/1/1760-1787, Rector of Bride 24/7/1754-1760, Archdeacon of Mann 17/6/1760
  4. He and Ellinor were recorded as having 13 children althought not all survived to adulthood. Of those who did:
    • Lucy b1756 married John Quayle
    • Daniel b1757 married Susannah Curphey and he followed his father's ecclesiastical path
    • Thomas b1758 was unmarried and an MHK in Ramsey
    • William b1760 was unmarried, a mariner who drowned 1787, probably during a slaving expedition
    • Cathrin b1768 married Robert Quayle and died after the birth of her first child
    • James b1770 was unmarried, a mariner who drowned 1794, probably during a slaving expetition
    • Basil b1771 was unmarried, a mariner who drowned, probably during a slaving expedition
  5. Rev. William died 1787
  6. Son Daniel followed in his father's footsteps and became a high ranking church official, and inherited the family estate. However, these lands were not the original Mylrea estate which had passed to William's older (and unmarried) brother who left them to his nephew Daniel (son of Thomas b1750) who promptly sold the lot
  7. Rev. William's will mentions lands in KK Patrick & KK German but only one purchase/sale contract survives. He & Ellinor also loaned money occasionally as this mortgage demonstrates
  8. Patrick Cowley MIGHT be the father of Pat Cowley who married Isabel Mylrea in 1785, the oldest daughter of John Mylrea of Ballacooiley. The
