JOHN MYLROIE 1908 Will Lonan

I John Mylroie of Glen View, South Cape, Laxey in the parish of Lonan, retired engineer, being of sound mind, memory and understanding do make this my last will and testament in manner following, hereby revoking and cancelling all wills heretofore made by me.

First I leave, devise and bequeath to my wife Maria Mylroie during her natural lifetime or as long as she remains a widow all rents, issues and profits arising annually out of the whole of my real estate that I may possess at the time of my decease. Upon the death or remarriage of my said wife Maria Mylroie I leave devise and bequeath the whole of my real estate of whatsoever nature or description to my cousin John Joughin Quilleash of Ramsey, retired engineer, his heirs and assigns, save and accepting that my cousin Mary Jane Quilleash of Ballaraugh in the said parish of Lonan if unmarried at my said wife’s decease but not otherwise shall have the use and enjoyment of my dwelling house, garden and premises situate at Ballaraugh in the said parish of Lonan so long as she remains unmarried. Moreover, so long as my said wife receives the rents, issues and profits out of my real estate she must see that the same is kept in fair tenantable order and condition.

And I leave, devise and bequeath to my three cousins namely Annie Quilleash, Georgina Quilleash and Mona Quilleash (daughters of my late uncle John Quilleash) the sum of one hundred pounds each payable at my wife’s decease out of my personal estate or at her re-marriage.

To each and every person having or pretending to have a right to claim in this my last will and testament I leave and bequeath the sum of one shilling.

Next I leave and bequeath the whole of the remainder of my personal estate of whatsoever nature or description to my said wife Maria Mylroie as her own absolutely.

Lastly I nominate constitute and appoint my wife Maria Mylroie executrix of this my last will and testament and also my cousin John Joughin Quilleash of Ramsey executor along with her of this my last will and testament and have hereunto subscribed my name this the seventeenth day of September one thousand, nine hundred and six (1906). The humble petition of Maria Mylroie of Glen View, South Cape, in the parish of Lonan widow and John Joughin Quilleash of the town of Ramsey, retired engineer

Sheweth as follows:

John Mylroie late of Glen View, South Cape, Laxey aforesaid, retired engineer, husband of your petitioner, died on or about the 29th day of November 1908 leaving a will in writing dated the 17th day of September 1906 whereof he appointed your petitioners executors

Wherefore your petitioners humbly pray a hearing hereof and that your honour may be pleased to grant to your petitioners probate of the said will and your petitioner will ever pray etc, ………. Advocate for petitioners

At a Court holden at Douglas on the 18th day of January 1909 The annexed paper writing dated 17th day of September 1906 having been proved to be the last will and testament of John Mylroie late of Glen View, South Cape, Laxey in the parish of Lonan, retired engineer, deceased who died on the 29th day of November 1908 at Glen View aforesaid, Maria Mylroie also of Glen View aforesaid, widow, the relict of the testator and John Joughin Quilleash of the town of Ramsey, retired engineer, a cousin of the testator, the executors therein named are sworn well and truly to fulfill and execute the same and to administer the personal estate of the said deceased according to law.

[A Deed was registered in 1913 by Annie Sayle Quilleash, and Wilfred Martin, and the certificate of registration was included in the papers associated with the will of John Mylroie but its significance is not apparent. John Mylroie bequeathed £100 to his cousin Annie Quilleash and this is probably the same person. The Document gives NATURE OF DEED Marriage Settlement.]

NOTES

  1. Ballaraugh
  2. John Mylroie was the younger - and only surviving- son of John Mylroie & Ann Quilleash. He was born in Lonan in 1846
  3. He was a miner, as his father was, but over the years rose up the ranks to become an engineer
  4. He married Maria Killip in Liverpool in 1903 when he was 57
  5. There were no children of the marriage
  6. The extent of the documentation associated with this will suggests that the next of kin were considered potential legatees although not all identified in John's will so presumably entitled to one shilling each. The Archival documentation does not record how the estate was finally dealt with
