Know all men by these presents that I Charles McYlrea jnr of KK Malew with the consent of Mary my wife divers good causes and considerations us hereunto moving but more especially for and in consideration of the sum of forty pounds currency of this Isle to us in hand paid by and from the hands of William Stole of the said parish the receipt whereof we do hereby acknowledge by being fully paid and satisfied have given, granted, bargained, alienated, passed over and sold and by these presents do give, grant, bargain, alienate, pass over and forever absolutely sell from us our heirs executors administrators and assigns all the right title and interest that we now have, heretofor had or at any time hereafter may, might or could have unto a certain parcel of Abbey lands in the said parish commonly called and known by the name of Voase or McYlrea’s Creggans adjoining to John Brew’s Creggans on the south east side to Boley-ne-Muck on the north west to Mr John Murray’s Creggans on the south west end and to the highway on the north east being a part of two shillings and sixpence rent unto him the said William Stole his heirs, executors, administrators and assigns forever from the date hereof to have and to hold unto him the said William Stole with all ways, waters, watercourses, easements, liberties and properties thereunto belonging or appertaining he yielding and paying such yearly rent as the Setting Quest shall set or allot thereon with all other dues duties suits and services payable out of the premises at the times and seasons accustomed and I the said Charles McYlrea and Mary my wife do hereby bind and oblige ourselves our heirs, executors, administrators and assigns to uphold, maintain, awarrant and defend the before mentioned Creggans with all its appurtenances unto him the said William Stole his heirs, executors, administrators and assigns against the pretended right of any person or persons claiming any right to any part, parcel, member of the premises and to do or cause to be done all and further act or acts thing or things that in shall be found requisite …. and necessary for the better strengthening and securing of the premises unto the said William Stole his heirs, executors, administrators and assigns [liken it]? to obtain the worshipful Deemsters attestation hereunto and the Honourable Court’s confirmation hereof but if in case it shall or may at any time hereafter appear that we had not the right in us to sell the before mentioned Creggans forever aforesaid but that the same at any time hereafter shall be taken or recovered from the said William Stole, his heirs, executors, administrators and assigns by law by any person or persons who hereafter will make their right to appear to the same then and in that case we the said Charles McYlrea and Mary my wife do hereby as absolutely sell unto him the said William Stole, his heirs, executors, administrators or assigns a certain parcel of our estate of Fildraw called by the name of the Lough Volley, Garey, ………Two Hills which four Ewan Looney has in mortgage with the field ....... our own possessing being fields in all ........

situate in the said parish as fully, effectively and entirely as the beforementioned Creggans is sold to all intents and purposes in the … of the said Creggans from us our heirs, executors, administrators and assigns and if ……….. should hereafter happen as that the said Creggans should be recovered he the said William Stole his heirs, executors, administrators and assigns as aforesaid and ……………………and either of them shall be dispossessed of the said parcels of Fildraw as aforementioned which he or they is to do immediately after they are or shall be dispossessed of the said Creggans as aforesaid then and in that case it shall be in the power of the said Charles McYlrea and Mary my wife our heirs, executors, administrators and assigns paying unto the said William Stole his heirs, executors, administrators ora ssigns the sum of fifty pounds to take, possess and enjoy the said parcels of Fildraw again in as full and ample a manner as if this had never been written anything heretofore to the contrary notwithstanding provided we or either of us do pay the same in one year after the said William Stole his heirs, executors, administrators or assigns is passed of the said parcels of Fildraw as before mentioned and for the true and faithful performance hereof and everything contained herein I the said Charles McYlrea and Mary my wife do bind and oblige ourselves our heirs, executors, administrators and assigns in the penalty or forfeiture of a hundred pounds to be paid according to law As witness our marks to our names this sixth day of November one thousand seven hundred and forty

Note before signing hereof that we have returned unto him the said William Stole the sum of twenty pounds of the said forty pounds which the said William Stole do hereby acknowledge to have received to redeem Ewan Looney out of the said parcel of Fildraw at the expiration of the said Ewan Looney’s mortgage so that it shall not be the power of us the said Charles McYlrea and Mary my wife our heirs, executors, administrators or assigns to ……… the said William Stole for the same .. of a debt or any …….. only for the redeption of the lands from the said Looney which he the said William Stole his heirs, executors, administrators or assigns is hereby empowered to do in as full and ample manner as we or either of us in any respect could do and he the said Stole is to pay unto the said Ewan Looney the interest that shall be due unto him on account of the said mortgage until the same shall be expired and this all in the penalty aforesaid Charles McYlrea my mark X, Mary McYlrea my mark X, William Stole

4th December 1740 Charles McYlrea and Mary McYlrea his wife came this day and acknowledged the within and above Bill of Sale with all the conditions and agreements therein mentioned to be their voluntary act and deed before me John Taubman

At an Abbey Court holden at Ballasalley the 15th May 1741 the within Bill of Sale with the conditions and agreements therein mentioned being acknowledged before the Deemster and now openly published in Court and no objection offered against them is therefore allowed of and confirmed according to law Dan McYlrea, John Taubman, Charles Stanley, John Quayle, William Christian,

We the Setting Quest of the Abbey lands of KK Malew being charged by virtue of the worshipful Deemster Taubman’s token to settle rent upon a part or parcel of Voase of McYlrea’s Creggans which Charles McYlrea sold to William Stole pursuant to the annexed Bill of Sale bearing date the 6th day of November 1740 and having this day accordingly met and viewed the said parcel of lands we do settle thereon two shillings and two pence and this we give as our return this 8th May 1841 William Bridson Thomas Cain Hen Clucas my mark X Robert Bridson my mark X 8th May 1741

  2. Charles jnr was the only surviving son born to Charles McYlrea snr & Margaret (als Kewley?)
  3. He married Mary Bell als Bridson c1736; five children Charles (1738-1741), John (1740), Robert (1742), William (1746), Thomas (1750)
  4. Mary died 1782; Charles jnr 1792. Little Charles McYlrea died aged three, four brothers followed for whom there are no records other than baptism
  5. This contract was executed on the same day that Charles jnr took a mortgage over three Fildraw fields in order to settle debts incurred by his father, Charles snr, in 1733. Such activity would suggest very straitened circumstances for the Mylreas. Half of the sale monies went immediately to Ewan Looney to settle the mortgage he held over Lough Volley, Two Hills & the Garey
  6. William Stole would also be a substantial mortgagee of Fildraw lands in 1744 & 1747. In 1735, Stole had bought the estate belonging to the Ballasalley Mylreas, the patriarch of whom was Martin who died in 1698
  7. Charles jnr took several more mortgages and sold more of Fildraw but eventually the estate was lost
  8. There is much about the Malew Mylreas of the 1600s and early 1700s that does not hang together so extreme caution must be exercised
