MORTGAGE - 1790 (Braddan)

Know all men by these presents that I William Cowley of the town of Douglas in the Isle of Man hereby own and acknowledge myself to be and stand justly endebted to Messrs Heywood, Daniel Mylrea and John Taubman and commonly named and known by the name or firm of Heywood, Mylrea & Co of Douglas aforesaid, merchants in the sum of two hundred and sixty-six pounds fourteen shillings British the payment of which said sum of two hundred and sixty-six pounds fourteen shillings with interest for and in respect of the same from the day of the date hereof at the rate of five pounds for an hundred pounds by the year well and truly to be made unto them the said Heywood, Mylrea & Co their heirs, executors and assigns at the end or expiration of twelve months from the date hereof I the said William Cowley do bind and oblige myself and my heirs, executors and administrators in the penalty herein after mentioned and for the further and better security of them the said Messrs Heywood, Mylrea & Co their executors administrators and assigns in the payment of the said principal sum of two hundred and sixty-six pounds fourteen shillings with the interest and the costs and charges I the said William Cowley by and with the consent and approbation of Isabel Cowley als Craine do hereby give, grant and make over to them the said Robert Heywood, Daniel Mylrea & John Taubman commonly named and known by the name of the house or firm of Heywood, Mylrea & Co all and singular that our dwelling house situate at the upper end of the town of Douglas aforesaid with all ways, waters, watercourses, easements, liberties and with the outhouses, offices, backsides and garden to the same belonging and adjoining being the whole of our concerns in Douglas aforesaid and also that carvel built smack or vessel now lying in the harbor of Douglas commonly called and known by the name George and Bella and whereof I the said William Cowley am sole owner and also master together with all her masts, sails, rigging, anchors, cables, small boat and materials to the said vessel belonging or in any wise appertaining to have and to hold the said hereby granted houses and concerns with the said vessel and all and singular the said premises herein before granted unto them the said Robert Heywood, Daniel Mylrea & Robert Taubman their executors, administrators or assigns as and by way of security for the due payment of the said principal money of two hundred and sixty-six pounds fourteen shillings British with the interest, costs and charges and for the true and faithful performance of these presents we the said William Cowley and Isabella my wife aforesaid do hereby bind and oblige ourselves and our heirs, executors and administrators in penalty of six hundred pounds British. 2nd November 1790 William Cowley and Isabel Cowley als Craine his wife acknowledged the foregoing Bond and Security to be their proper act and deed and that the consideration money therein mentioned has been paid. Before me John Cosnahan

At a Court Baron holden at Douglas for Garff Sheading this 10th day of November 1790 The before written Bond and Security being acknowledged before the High Bailiff and now openly published in Court and no objection offered against it the same is therefore allowed of and confirmed. Robert Heywood esq one of the mortgagees in the before written Deed of Mortgage named and the acting manager of the house or firm of merchants called Heywood, Mylrea & Co in the said mortgage or Bond and Security also named doth hereby acknowledge to be fully paid and satisfied the principal, interest, costs and charges in this mortgage or Bond & Security and doth therefore cancel the same. NOTES

  1. Daniel Mylrea was the son of Thomas Mylrea & Rose Savage, and baptised Peel 1750
  2. His was the Deemster/Archdeacon/Attorney General line of Mylreas; once possessors of the Dollough estate
  3. He became a wealthy young man when he sold off the Dollough, the Mylrea family estate in Ballaugh left to him by his bachelor uncle, Daniel Mylrea (Deemster)
  4. Daniel was in business in Douglas with Robert Heywood, his brother-in-law, and John Taubman snr
  5. These men were both of the Deemster families of the Isle of Man
  6. Daniel & Robert Heywood were recorded as shipowners, in 1781, importing goods to Liverpool from Barbados (Ref:Wilks)
  7. Heywood, Mylrea & Co were evidently money lenders as this and an earlier mortgage with Cowley shows
  8. This particular contract was the second with William Cowley, and the same collateral was offered on both occasions, suggesting that this contract was a re-statement of the earlier one but now including the accumulated interested, costs and charges
  9. Less than a decade after this contract, Daniel was married for a second time, the first of his five children had been born, he was in the British Army and apparently he was of very limited means
