DANIEL McYLREA jnr from THOMAS THOMPSON

PURCHASE - 1731 (Ballaugh)

Whereas Thomas Thompson of Ballamona in the parish of Ballaugh in the Isle of Man have already granted, bargained and sold unto Mr Daniel Mcylrea Attorney General of the said Isle a certain parcel of my Intacks in that parish called Close-e-Reay adjoining to the Bishop’s Turberry on the east side, to Thomas Cowley’s land on the south and to Killabricka’s land, Thomas McYlvorrey’s and Boddaugh’s lands on the north side thereof of the annual rent of two shillings and eight pence or whatever rent should appear by record to be payable out of the same excepting and reserving a corner of the north east end of the said close adjoining to Bishop’s Turberry on the east side and from the lands of Thomas McYlvorrey on the north side along in a direct line upon the east side of two Curraugh sticks or stakes fixed in the ground for a moar unto a trench in or about the middle of the said close; for and in consideration of the just and entire sum of one hundred and thirty five pounds sterling currency of this Isle paid unto me fully as appears by Deed of Sale and receipt for the said sum both bearing the date the twenty-ninth day of September last past and whereas my affairs and occasions do at this time necessitate me to dispose of the said corner or parcel reserved or excepted by the said Deed of Sale as aforesaid.

Know all me therefore by these presents that I the said Thomas Thompson for and in consideration of the sum of one hundred and thirty-five pounds mentioned in the said former Deed as also for and in consideration of the further sum of thirty pounds sterling currency of this Isle to be paid unto me at the Deemster’s attestation of this Deed by, from and at the hands of the said Daniel Mcylrea Attorney General over and besides sundry other goods and valuable causes and reasons me hereunto moving have given, granted, bargained, passed over, sold and confirmed and do by these presents give, grant, bargain, pass over, sell forever and absolutely confirm not only that part of the said parcel of Intack called Close-e-Reay in Ballaugh parish mentioned, sold, conveyed, and made over in and by the said former Deed of Sale bounded and moared as aforesaid but likewise the remaining corner or parcel of the said Close excepted and reserved by and out of the said Deed in the northeast and of the said close adjoining to the Bishop’s Turberry on the east side and from the lands of Thomas McYlvorrey on the north side along in direct line upon the east side of two Curraugh sticks of stakes fixed in the ground for a moar unto the trench in or about the middle of the said Close unto him the said Dan Mcylrea his heirs, executors, administrators and assigns from me my heirs, executors, administrators forever so that now he the said Dan Mcylrea is fully invested with the right and title of the whole of the said parcel of Intack called Close-e-Reay adjoining to the Bopp’s Turberry on the east side to Thomas Cowley’s land on the south, to the road on the west and to Killabricka’s, McYlvorrey’s and Boddaugh’s lands on the north without any exception of reserve whatsoever being of the annual rent of two shillings and eight pence to the Lords or such rent as shall appear by record to be due and payable out of the same to have and to hold the whole and entire premises and ever part and parcel thereof unto him the said Dan Mcylrea his heirs, executors, administrators and assigns forever as aforesaid with all and every the advantages and appurtenances and all ways, waters, watercourses, easements, liberties and properties whatsoever thereunto belonging or in any wise appertaining he the said Dan Mcylrea his heirs, executors, administrators and assigns yielding and paying the said yearly Lord’s rent with all other dues, duties, suits and services yearly due and payable out of the premises at the times and seasons accustomed and I the said Thomas Thompson do hereby promise, covenant and engage by these presents to and with the said Dan Mcylrea that I am of full power and capacity to sell the premises and the same to uphold, awarrant, and maintain and defend wholly and entirely unto him the said Dan Mcylrea his heirs, executors, administrators and assigns against all person or persons whatsoever and likewise to procure the Governor’s and officer’s confirmation of this Deed and perform and execute all and every other act and acts necessary to be done in law or otherwise for the said Dan Mcylrea’s better and more ample security in and unto the premises according to the tenor, purpose and true meaning of these presents and for the true and faithful performance hereof and of all and singular the premises I the said Thomas Thompson do firmly bind and oblige myself my heirs, executors, administrators and assigns in the penalty and forfeiture of three hundred and thirty pounds sterling half to the Lord of the Isle and the other half to the party grieved according to the custom of the said Isle in such cases. I do hereby acknowledge and confess to have this day received at, by and from the hands of Mr Dan Mcylrea Attorney General the just and entire sum of thirty pounds sterling currency of this Isle which with the sum of one hundred and thirty-five pounds by me received the 29th September last past completes the sum of one hundred and sixty-five pounds and is therefore consideration money of all the premises mentioned in the within Deed of Sale from the payment of all which said sum and sums of money I do hereby acquit, exonerate and discharge him the said Dan Mcylrea his heirs, executors, administrators and assigns as witness my hand this 8th day of March 1731. 12th September 1732 The three subscribing witnesses to the before going Deed of Sale came this day and made oath that the same was duly executed by the above named Thomas Thompson in their presence and that the consideration money of thirty pounds therein mentioned was also paid him in their presence according to the above discharge. At a Sheading Court holden at Peel the 5th October 1732 The before going Deed of Sale being proved before the Deemster and now published in open Court and no objection made against it therefore the same is allowed of and confirmed according to law.   2. Daniel McYlrea jnr, son of Daniel Mylrea (Deemster) and Margaret Curlett als Parr, baptised 1684 in Ballaugh
  3. Grand father William was the parish Captain of Ballaugh; father Daniel was Attorney General 1690-1695, and Deemster 1695-1724; Daniel jnr was Attorney General 1720, Deemster 1734-1757
  4. Married Lucy Parry about 1715, probably in England; 11 children of whom 5 reached full adulthood
  5. This current contract is for a large sum (£165 ) for the time, a further indication of the prosperity of this family
  6. In 1709, the parents of Daniel jnr settled the Dollough estate on their (then) unmarried 25 year old son, Daniel jnr, and bound him to purchase more land (which he did), and to pass everything on as inheritance.
  7. This plan came to nought with the son of Daniel jnr (also named Daniel) who died a bachelor and left the Dollough estate to his oldest nephew (also named Daniel) who promptly sold the estate in many parcels in 1777.
