Norris Moore vs John Stephen

Conchan
Norris Moore of the town of Douglas complaineth against John Stephen of the said town and showeth that Philip Higgins of the said town some time ago, deceased, was in his lifetime well entitled unto and possessed and enjoyed all that dwelling house and premises wherein the said defendant now lives of the annual chief rent of one shilling and three pence or thereabouts
That the said Philip Higgins some time in the year 1770 departed this life so seized and possessed by means whereof Jane Moore als Higgins now the wife of Charles Moore of the said town, labourer, the only surviving child and heir at law and executrix and residuary legatee named in and by the last will and testament of Philip Higgins, deceased, became well and legally entitled to the said dwelling house and premises
That the said Charles Moore and Jane Moore als Higgin his wife did by Deed by them duly executed and bearing date the 17th March 1788 for and in consideration of the sum of twenty one pounds lawful money of Great Britain to them in hand paid by the plaintiff grant, bargain and sell unto the plaintiff all that the said dwelling house and premises of the said annual Chief rent of one shilling and three pence or thereabouts by means whereof the plaintiff is well entitled to the said dwelling house and premises
That the said defendant notwithstanding the premises some time ago insinuate himself into possession of the said premises and the same doth he possess and enjoy by means whereof the plaintiff is damaged in the sum of one hundred pounds and for the recovery of the said dwelling house and premises of one shilling and three pence chief rent the plaintiff brings suit and prays judgement according to the due course of the Court's Law

NOTES
- The date on which Philip's will was signed has been lost from the original document. He left his assets to his daughters -Mary b1742/3 and Jane 1752
- Mary has died,perhaps on the 14th April 1767 when she would have been about 23 years old. She was bequeathed a house and stable by her father so it is surprising that her father who died over two years later, had not amended his will
- Jane Moore als Higgins was the only surviving child of Phil Higgins jnr and Mary Hault, the second wife of Phil Higgins jnr
- Jane was the great grand daughter of Jane McYlroy who married Philip Higgins snr in 1703
